By making a booking with CharmFlights, you confirm that you and all members of your party are authorized to accept these terms and conditions. This user agreement is governed by the laws of England.

Contract:

CharmFlights is operated by CharmFlights LTD, incorporated in England & Wales, Company No: 15921033, with the registered address at Office 6811 182-184 High Street North, East Ham, London, United Kingdom, E6 2JA. The individual who purchased the tickets and made the booking must be aged 18 or over and is responsible for accepting these conditions on behalf of all passengers in the booking, as well as ensuring all payments due from the party are made.

We act as a disclosed agent for third-party suppliers, including airlines, tour operators, and consolidators. When you book a product, the supplier’s booking conditions, along with the airline’s conditions of carriage, will also apply to your booking contract. We strongly recommend that you read the supplier’s terms and conditions before completing your transaction with us, as they contain important information. You can request a copy of the supplier’s conditions from us. Your ticket wallet or travel documents will include the supplier’s and airline’s conditions of carriage.

Liability Protection:

As agents, we do not accept responsibility for the products or services provided by the supplier. However, we could still be liable to you if we have acted negligently or misrepresented important information.

Your Obligations:

All transactions made under your name or account are subject to your financial responsibility. Purchases must be made by individuals over the age of 18, purchasing for themselves or having the legal capacity to do so. In the case of a group, party, or family booking, you will be responsible for the payment of all members.

Please ensure that all the information you provide to us is true and accurate. Any changes to your address, email address, or phone number should be notified to us immediately in writing. If you fail to provide accurate and complete credit or debit card details, including the cardholder’s name and billing address, your tickets may not be issued, the fare may increase, or your booking may be cancelled. Ensure that your details match those on your card or statement to avoid delays or cancellations. This website should not be used for speculative, false, or fraudulent bookings.

Supplier Conditions:

You must adhere to an airline’s terms, such as check-in times and reconfirmation of flights. CharmFlights is not responsible for bookings cancelled due to non-compliance with the airline’s rules.

Ticket fares for scheduled flights are subject to additional conditions. These may include conditions related to changes, refunds, and duration of stay. In general, flexible tickets tend to be more expensive, so consider a variety of factors before choosing between the fares.

Tickets must be used in the order set out on your itinerary. Failure to do so may result in the cancellation of any onward flights, and you will not be refunded. Some airlines require you to reconfirm your flight 72 hours in advance. Failure to do so may result in your flight being cancelled, and you may not receive a refund. CharmFlights strongly recommends confirming every flight via this method in case of a last-minute schedule change.

Information on the Site:

We do not guarantee that information on CharmFlights (including prices, descriptions, and dates) is accurate or suitable for your intended use. We will make every reasonable effort to correct any errors or omissions as soon as they are brought to our attention.

CharmFlights provides general information on the site for guidance purposes only. The site and its content are subject to change at any time, including the availability of any suppliers, features, or information.

Links:

There are links on the CharmFlights website that lead to third-party websites. We do not control or maintain these linked websites and therefore do not accept responsibility for their accuracy, completeness, or quality. CharmFlights is not liable for any loss or damage that may result from the use of, reliance upon, or access to any content, goods, or services available on those websites.

Pricing:

The prices listed on our website are in British Pounds Sterling and are subject to change without notice. Taxes and transaction fees are included in all fares quoted at the ‘confirmed quotation’ stage, and together these form your final quotation.

Depending on the destination, you may be required to pay a departure tax and/or an arrival tax locally. These taxes are the passenger’s responsibility, and CharmFlights is not responsible for denied boarding if such taxes are not paid.

Ticket prices may include a booking or transaction fee charged by CharmFlights. This is our non-refundable fee for making and managing your booking.

In addition, service fees are charged for other types of administration, such as reservation changes and refund requests.

Please note that fares are subject to change without prior notice. If the fare for your trip changes due to the airline or if we discover that you have paid the wrong fare, we will try to notify you as soon as possible. You will be liable for any differences in fares. Unpaid fares may result in the airline refusing to allow travel, and we may cancel the contract without any liability to you.

Scheduled flight ‘Special Fares’ are subject to verification by ticketing staff. You will be notified within three working days if the quoted fare is not available.

When booking a product priced in a different currency, a currency conversion and exchange rate fluctuation fee may be included.

Denied Boarding, Flight Delays, and Cancellations:

Information about these rights can be found in the baggage claim area of airlines and at airports throughout Europe. In such cases, the airline is responsible for any payment or reimbursement.

Community List:

The European Union requires us to inform you of the existence of a Community List of air carriers whose operations are prohibited within the EU. You can view the list at www.ec.europa.eu/transport/air-ban/list_en.htm.

Making a Booking / Booking Details:

All travel products and services featured on the site are subject to availability.

Online Booking:

You must provide all required information when booking online. Ensure you use your own credit or debit card (or, subject to our agreement, that you have express authorization if it is a third party’s) and that you have sufficient funds to cover the costs of the arrangements you book.

We will confirm your booking by e-mail and debit payment from your account once your booking is accepted. We do not guarantee that any package holiday, flight, or individual component will be available, nor that our booking services will be free from viruses or anything else that can contaminate or damage your property.

Telephone Bookings:

When making a telephone reservation, you must provide all necessary information. Ensure all information provided is accurate and that you use your own credit or debit card, or, subject to our agreement, that if it’s a third party’s, you have their express permission to do so, and you have sufficient funds to cover the cost of the arrangements.

We will debit your credit card and send you a confirmation once your booking has been accepted. From this point onward, cancellation charges will apply. It is important that phone bookings be confirmed in writing to avoid any misunderstandings. Once you receive the confirmation request, carefully review the details and let us know if anything seems incorrect right away. Following confirmation of these details, we will contact the supplier(s) to confirm the booking.

Special Requests:

For additional preferences (such as seating, dietary requirements, or assistance), we are happy to forward the information to the appropriate travel provider. However, as these are special requests, they cannot be guaranteed to be fulfilled.

Pregnancy:

If you are pregnant and traveling, please note that airlines have regulations regarding passengers who are more than a certain number of weeks pregnant. As these regulations differ between airlines, it is your responsibility to check their policies before booking. In some cases, travelers may not be allowed to travel, or may need to obtain a doctor’s letter, or even medical clearance from the airline.

Ensure that your travel insurance covers pregnancy. Please consult your doctor before booking to ensure you are fit to travel.

Traveling with Children:

Airlines require an original Date of Birth Certificate for children traveling to South Africa.

Traveling with Infants:

Infants may only travel with airlines if they have reached a minimum age (normally six weeks). Before making a reservation, please review the airline’s policy.

Unless you are flying with an airline that has infant seats available, infants must either sit on an adult’s lap or occupy an infant seat. Please contact your airline for more information on infant seats.

An infant who is under two years old on the date of return travel is generally eligible for an infant fare. Seats must be reserved for children over two years of age.

Paying for Your Booking:

The site provides the option to pay with a number of debit and credit cards, as well as an Ecommerce link for payment. CharmFlights may pass the details of your credit or debit card to the relevant supplier for the purpose of fulfilling the booking.

Full payment by credit card or debit card is required at the time of booking for scheduled flights and web fares. All credit card transactions may be subject to a surcharge.

If the card issuer declines payment or if the card details or billing information are incorrect, we reserve the right to cancel a booking before or after it is issued.

Upon failure of payment, CharmFlights will not be held liable for any increase in fares.

We may also conduct random checks, including checks of the electoral roll, in an effort to minimize the effects of credit card fraud. Before issuing any tickets, we may request that you fax or email us proof of your address, a copy of your credit/debit card and recent statement, or a copy of the cardholder’s and/or passenger’s passport(s). In some cases, we may require that travel documents be sent to the billing address of the credit card used to make the booking. In the event of a chargeback, CharmFlights reserves the right to pass on the charges. As a British company, we are not liable for any foreign exchange charges or fees imposed by the bank.

If a transaction is found to be fraudulent, the airline may cancel the booking without notification.

Customer Services / Complaints:

All customer service issues and complaints must be reported in writing or by email within 28 days of returning from the holiday. To assist with handling complaints, please include your booking reference and all relevant information.

Where possible, complaints should be raised with the airline, hotel, or other supplier at the time to give them the opportunity to resolve the issue immediately. Complaints not reported within this time may not be considered by the supplier.

If a complaint is resolved at the destination, compensation or refunds may not be offered at a later date. Please allow up to 28 days for us to investigate and respond.

If the dispute relates to a booking made online, you may refer it to the European Commission’s Online Dispute Resolution (ODR) platform.

Communication / Documentation:

For all documents and communication related to your booking, the address provided during the booking process will be used. If there is a change in your address, please notify us in writing.

It is essential to check all documentation carefully when you receive it. If any errors are found, notify us immediately as changes may not be possible later. We will send all travel documents via email unless otherwise agreed.

Data Protection:

To make a booking through CharmFlights, certain personal data will be collected and used to fulfill your booking. This information will be shared with the relevant suppliers, such as airlines, hotels, and payment processing companies. We adhere to strict data protection laws and ensure that your information is stored securely and only shared with third parties for the purposes of your booking.

Privacy Policy:

For more details on how we handle your personal information, please refer to our Privacy Policy. By booking with CharmFlights, you consent to the collection, use, and transfer of your information as outlined in our Privacy Policy.

Cancellation and Refund Policy:

All cancellations must be made in writing, and fees will apply as specified by the supplier. Non-refundable tickets and certain promotional fares are not eligible for refunds.

If a flight is cancelled by the airline, you will be entitled to a refund or rebooking as per the airline’s policy. Refunds will be processed within the time frame specified by the airline or supplier.

Force Majeure:

CharmFlights will not be liable for any failure to perform its obligations where such failure is as a result of Acts of Nature (including but not limited to fire, flood, earthquake, storm, hurricane, or other natural disaster), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalization, government sanction, blockage, embargo, labor dispute, strike, lockout or interruption or failure of electricity or telephone service.

Severability:

If any provision of these terms and conditions is found to be invalid, illegal, or unenforceable, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.

Entire Agreement:

These terms and conditions, together with any supplier terms referred to herein, constitute the entire agreement between CharmFlights and the customer. Any variation or modification of these terms and conditions must be agreed upon in writing by CharmFlights.

Law and Jurisdiction:

These terms and conditions are governed by the laws of England, and any disputes arising under or in connection with these terms and conditions shall be subject to the jurisdiction of the English courts.
